AN ACT repealing the court civil filing fee surcharge.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Repeal. RSA 490:26-a, II, relative to the court civil filing fee surcharge, is repealed.
2 References Deleted; Court Fees and Fines. Amend RSA 490:26-a, III to read as follows:
III. All court fees[, surcharges,] and fines paid into any court may be paid by credit card in lieu of cash payment. The courts shall collect a $3 processing fee in addition to each fee[, surcharge,] or fine paid by credit card.
3 Effective Date. This act shall take effect January 1, 2009.

AN ACT repealing the court civil filing fee surcharge.
FISCAL IMPACT:
The Judicial Branch states this bill will decrease state general fund revenue by $394,188 in FY 2009, $788,375 in FY 2010 and each year thereafter. There is no fiscal impact on county and local revenue or state, county, and local expenditures.
METHODOLOGY:
The Judicial Branch states this bill repeals the $25.00 surcharge on certain court civil filing fees enacted by Chapter 263:77, Laws of 2007. The Branch indicates the surcharge would apply to 31,535 filings annually. The repeal of the surcharge would decrease state revenue by $788,375 (31,535 * $25.00) each year. This repeal would take effect January 1, 2009, so for FY 2009 the decrease in revenue would be $394,188 ($788,375 / 2).
