STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT establishing a selection process for compulsory assistant election official service.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Assistant Election Officials; Selection. Amend RSA 658 by inserting after section 7-a the following new section:

658:7-b Selection.

I. All assistant election officials shall be appointed from the pool determined in accordance with this section. The city or town shall pay all assistant election officials appointed from the pool $10 per hour for their service on election day.

II. Each city or town shall devise and place into operation a written plan for random selection of assistant election officials. The plan shall:

(a) Authorize the clerk to manage the assistant election official pool process.

(b) Specify that the names of prospective assistant election officials shall be drawn from the checklist of the city, town, or ward in which they are to be appointed.

(c) Ensure the random selection of a fair cross section of the persons residing in the community.

(d) Specify that the following persons are exempt:

(1) Members in active service in the armed forces of the United States.

(2) Members of the fire or police departments of the state or any political subdivision of the state.

(3) Emergency personnel determined by the city or town, whether paid or volunteer.

(e) Fix the time when the names drawn from the checklist shall be disclosed to the public.

(f) Specify the procedures to be followed by the clerk in assigning persons whose names have been drawn from the checklist, if there is more than one polling place in the city, ward, or town.

III. The clerk shall mail to every person whose name is drawn from the checklist an acknowledgment form accompanied by instructions to fill out and return the form, duly signed and sworn, to the clerk by mail within 10 days. If the person is unable to fill out the form, another shall do it for him or her, and shall indicate that he or she has done so and the reason therefor.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 1362-FN - FISCAL NOTE

AN ACT establishing a selection process for compulsory assistant election official service.

FISCAL IMPACT:

      The New Hampshire Municipal Association states this bill will increase local expenditures by an indeterminable amount in FY 2008 and each year thereafter. There is no fiscal impact on state and county expenditures or state, county, and local revenues.

METHODOLOGY:

    The New Hampshire Municipal Association states this bill establishes a selection process for assistant election officials and requires the municipalities to pay assistant election officials $10 per hour. The Association indicates the number of assistant election officials appointed is at the discretion of the moderator. The Association is not able to determine how many assistant election officials would be appointed or the total cost associated with the assistant election officials.
