STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eight
AN ACT relative to allowing driveway construction permit fees.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subparagraph; Driveway Construction Permit Fees. Amend RSA 236:13, III by inserting after subparagraph (c) the following new subparagraph:
(d) The department of transportation may charge a fee to cover costs expended to perform engineering reviews and construction inspections associated with the issuance of driveway permits issued under this paragraph. The fee for work performed by department technical and engineering personnel shall be $65 per hour. The fee for work performed by consultants engaged by the department to assist with this work will be the actual costs charged by the consultant, not to exceed $105.00 per hour.
2 New Paragraph; Required Rulemaking. Amend RSA 21-L:12 by inserting after paragraph X the following new paragraph:
X-a. Fees for driveway construction permits, as authorized by RSA 236:13, III(d).
3 Effective Date. This act shall take effect 60 days after its passage.

AN ACT relative to allowing driveway construction permit fees.
FISCAL IMPACT:
The Department of Transportation states this bill will increase state highway fund revenue by $512,500 in FY 2009 and $615,000 in FY 2010 and each fiscal year thereafter. There will be no fiscal impact on state, county and local expenditures or county and local revenues.
METHODOLOGY:
The Department of Transportation (DOT) states that this bill allows DOT to charge $65 per hour for commercial, industrial enterprise, or subdivision driveway construction permits. DOT typically reviews 30 major developments per year along the state highway system. Each development review involves approximately 315 staff hours or a total (315 hours for each of the 30 reviews) or 9,450 staff hours. Using an hourly rate of $65 stated in the bill (which includes labor, benefits, and overhead), the total state highway fund revenue increase is estimated at approximately $615,000. Since the Department currently conducts these reviews there will be no additional expenditures by the Department. The Department further assumed an implementation date of September 1, 2008 and reduced the revenue estimate for FY 2009 to $512,500.
