STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT establishing a commission on larviciding.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Commission Established. Amend RSA 430 by inserting after section 20 the following new section:

430:20-a Commission Established.

I. There is established a commission to examine the public health issues of mosquito infestation and larviciding.

II.(a) The members of the commission shall be as follows:

(1) The director of the division of public health services, department of health and human services.

(2) The executive director of the department of fish and game.

(3) The commissioner of the department of resources and economic development.

(4) The state epidemiologist.

(5) A doctor of veterinary medicine from the department of health and human services appointed by the commissioner.

(6) The commissioner of the department of agriculture, markets and food.

(7) The governor, or designee.

(b) The commission shall serve without compensation.

III. The commission shall:

(a) Examine annually the public health threat posed by mosquitoes.

(b) Communicate with the Center for Disease Control and public health departments of other states.

(c) Communicate with public officials of each town.

(d) Decide which towns should conduct mosquito control activities on state owned property and to what extent.

(e) Choose methods of larvicide that are safest for humans, the environment, and animals.

(f) Determine the policy of the state from year to year based upon sample testing.

IV. The commission shall report its findings and recommendations annually by February 28 to the director of the department of fish and game, the commissioner of the department of agriculture, markets, and food, the public health officer of each city and town in New Hampshire, the superintendent of each school district in New Hampshire, the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library.

2 Effective Date. This act shall take effect July 1, 2008.
