STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to the fuel oil import fee.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Fuel Oil Import Fee Increase. Amend RSA 146-E:3, II to read as follows:

II. A fee of [$.01] $.012 per gallon of fuel oil shall be assessed at the time of importation into this state. Persons licensed under RSA 146-A:11-b, II shall be liable for payment of this additional fee which shall be collected and enforced in the manner described in RSA 146-D:3, III and V. All fee revenues shall be deposited in the fuel oil discharge cleanup fund. If the fund's balance becomes greater than $2,500,000, the assessment of fees shall be discontinued and only reestablished when the fund's balance is less than $1,500,000. Until the fund balance reaches $2,000,000, at least 50 percent of the fees collected shall be allocated for reimbursements to on-premise-use facility owners and owners of land upon which on-premise-use facilities are located and for the administrative, technical and legal support associated with such reimbursements.

2 Effective Date. This act shall take effect July 1, 2008.

HB 1427-FN-A - FISCAL NOTE

AN ACT relative to the fuel oil import fee.

FISCAL IMPACT:

      The Department of Environmental Services states this bill will increase state restricted revenue by $630,079 and increase state, county and local expenditures by an indeterminable amount in FY 2009 and each year thereafter. There is no fiscal impact on county and local revenue.

METHODOLOGY:

    The Department of Environmental Services states this bill increases the fuel oil import fee from $.01 to $.012 per gallon of fuel oil. The Department estimates 315,039,700 gallons of fuel oil are imported to the State. The increase in the fuel oil import fee will increase Fuel Oil Discharge Cleanup Fund revenue by $630,079 (315,039,700 gallons * $.002). The Department states expenditures related to state fuel oil contamination cleanup and storage tank upgrades will increase as more funds become available for reimbursement through fuel oil import fee revenues. Additionally, the Department indicates state, county, and local expenditures will increase $.002 for every gallon of fuel oil purchased.
