STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT requiring the public utilities commission to provide cost recovery for construction of generation assets by Public Service Company of New Hampshire.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Cost Recovery for Construction of PSNH Assets. Amend RSA 369-B:3-a to read as follows:

369-B:3-a Divestiture of PSNH Generation Assets. The sale of PSNH fossil and hydro generation assets shall not take place before April 30, 2006. Notwithstanding RSA 374:30, subsequent to April 30, 2006, PSNH may divest its generation assets if the commission finds that it is in the economic interest of retail customers of PSNH to do so, and provides for the cost recovery of such divestiture. Prior to any divestiture of its generation assets, PSNH may construct, modify, or retire such generation assets if the commission finds that it is in the public interest of retail customers of PSNH to do so, and provides for the cost recovery of such construction, modification, or retirement.

2 Request for Proposals. The public utilities commission is authorized to prepare a request for proposals from interested parties, regulated and unregulated, for the purpose of siting, constructing, and operating by that entity a biomass-fueled electric generation facility in northern New Hampshire. The request for proposals due date shall be no later than December 31, 2008.

3 Effective Date. This act shall take effect upon its passage.
