STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT establishing a commission to study the feasibility of constructing a state hospital facility to treat certain youths addicted to heroin or cocaine.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study the feasibility of constructing a state hospital facility to treat certain youths addicted to heroin or cocaine.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Three members of the senate, appointed by the president of the senate.

(c) A representative of the department of health and human services familiar with youth drug offender programs, appointed by the commissioner of health and human services.

(d) A representative of the department of corrections, familiar with the department’s drug treatment programs, appointed by the commissioner of corrections.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties. The commission shall study the feasibility of building a state hospital for persons between 14 and 18 years of age who are addicted to heroin or cocaine and shall consider the possibility of establishing an isolated, long-term treatment program for heroin, cocaine, and similar drug addictions. The commission also shall examine the need for such programs in the state, the adequacy of existing programs, and the feasibility of extending current treatment programs for heroin and cocaine addiction.

4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Four members of the commission shall constitute a quorum.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2008.

6 Effective Date. This act shall take effect upon its passage.
