STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT creating a commission to study the recycling and disposal of electronic waste.

Be it Enacted by the Senate and House of Representatives in General Court convened:

33:1 Commission Established. There is established a commission to study the recycling and disposal of electronic waste.

33:2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Six members of the house of representatives, appointed by the speaker of the house of representatives.

(b) One member of the senate, appointed by the president of the senate.

(c) A member from the waste management division of the department of environmental services, appointed by the commissioner of the department of environmental services.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

33:3 Duties. The commission shall study:

I. Other states’ electronic waste programs, including manufacturer takeback programs and programs involving an advanced recycling fee structure.

II. Definitions of electronic waste.

III. Costs and effects of a ban on the disposal and incineration of electronic waste products.

IV. Expansion of electronic waste recycling to residential areas, municipalities, local government offices, and businesses.

V. Performance goals for electronic waste recycling.

VI. Possible end-points for recycled electronic waste.

VII. Manufacturer incentives to produce electronic products that create little to no electronic waste.

VIII. Any further information that would expand the commission’s knowledge of electronic waste collection and recycling.

33:4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Three members of the commission shall constitute a quorum.

33:5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before December 1, 2008.

33:6 Effective Date. This act shall take effect upon its passage.
