STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT requiring road toll revenues to be spent on highways and bridges.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Disposal of Revenue. Amend RSA 260:59 to read as follows:

260:59 Disposal of Revenue. All revenue from the motor vehicle road toll law, after paying the expense of collection, is to be disposed of [in like manner as the revenue from the registration fees of motor vehicles, except as provided in the following sections.] as follows:

I. During the legislative session ending 2010,

(a) A minimum of 75 percent exclusively for the construction, reconstruction, and maintenance of public highways within the state, including payment of the interest and principal of obligations incurred for such purpose.

(b) A maximum of 25 percent for supervision of traffic on public highways.

II. During the legislative session ending 2012 and thereafter,

(a) A minimum of 90 percent exclusively for the construction, reconstruction, and maintenance of public highways within the state, including payment of the interest and principal of obligations incurred for such purpose.

(b) A maximum of 10 percent for supervision of traffic on public highways.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 1592-FN-A - FISCAL NOTE

AN ACT requiring road toll revenues to be spent on highways and bridges.

FISCAL IMPACT:

      The Department of Safety states this bill may have indeterminable impact on state expenditures in FY 2010 and each fiscal year thereafter. There will be no fiscal impact on state, county and local revenues or county and local expenditures.

METHODOLOGY:

    The Department of Safety states this bill would not increase overall state highway fund expenditures, however, by placing a minimum percentage required on construction, reconstruction and maintenance of public highways and maximum for supervision of traffic on state highways, would decrease the amount of state highway funds specifically allocated to the Department of Safety for expenditure. If these funds were replaced by other state funding, state expenditures would increase, if not replaced, Safety would be required to reduce expenditures in areas supported by highway funds.

    The Department of Transportation (DOT) states that this bill will not change total DOT highway fund expenditures. DOT states that any decrease in expenditures that would have been paid to the Department of Safety as a result of this bill, will be offset by increased DOT expenditures for construction, reconstruction and maintenance on state public highways.
