ANALYSIS

This bill establishes a committee to study the procedures and standards used by the state when contracting with private entities for delivery of public services.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT establishing a committee to study procedures and standards used by the state in public service contracts.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Committee Established. There is established a committee to study procedures and standards used by the state in public service contracts.

2 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) Four members of the house of representatives, appointed by the speaker of the house of representatives, 2 of whom shall be members of the executive departments and administration committee, one of whom shall be a member of the finance committee, and one of whom shall be a member of division one of the finance committee.

(b) Two members of the senate, appointed by the president of the senate, one of whom shall be a member of the executive departments and administration committee.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

3 Duties. The committee shall:

I. Examine the extent of outsourcing or privatization of public services that are ongoing or long-term in nature with the goal of standardizing state contracting policies and procedures in a manner that best serves the interests of the citizens of New Hampshire as well as the needs of service recipients.

II. Examine the findings and recommendations of the committee to study the cost, quality, accountability, and oversight standards used by the state when contracting with private entities for delivery of public services, established in 2007, 223, and the commission to assess the operating efficiency of state government, established in 2003, 1.

III. Solicit information and testimony from:

(a) Any state agency that enters into service contracts with private providers.

(b) A representative of the State Employees’ Association of New Hampshire, Inc.

(c) Any other person or organization with information or expertise the committee deems relevant to its study.

4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Four members of the committee shall constitute a quorum.

5 Report. The committee shall submit an interim report of its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2008. The committee shall submit a final report on or before November 1, 2009.

6 Effective Date. This act shall take effect upon its passage.
