STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to the definition of swine as a nuisance.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Swine Removed. Amend RSA 147:10 to read as follows:

147:10 Nuisances; When; Regulations. No privy, toilet, sink, drain, cesspool, septic tank, or the discharges from such facilities, [and no pen or sty for swine,] shall be erected or continued in such place or condition as, in the judgment of the health officers, to be a nuisance or injurious to the public health. The health officer may make, in the manner provided in RSA 147:1, such regulations as necessary to ensure the safety and adequacy of subsurface sanitary disposal systems within the municipality. Nothing in this section shall be construed to limit the authority conferred upon the department of environmental services under RSA 485-A.

2 Effective Date. This act shall take effect January 1, 2008.
