STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to incompatible offices.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Nominations; Incompatible Offices. Amend RSA 655:10, II-III to read as follows:

II. No person shall [be nominated] accept nominations for incompatible offices. If a person shall be nominated for incompatible offices and one of the nominations is by write-in vote, the secretary of state shall advise the person of the provisions hereof and the person shall then advise the secretary of state which nomination the person wishes to [retain] accept; the secretary of state shall declare the nominations not [retained] accepted by the person vacant.

III. A party shall not designate a person to fill a vacancy if the person has [been nominated] filed for any incompatible office at the same election.

2 Effective Date. This act shall take effect 60 days after its passage.
