AN ACT requiring the supreme court to notify the legislature of any pending cases or matters before the court which involve constitutional issues regarding current law or pending legislation.

This bill requires the supreme court to notify the legislature of any pending cases or matters before the court which involve constitutional issues regarding current law or pending legislation. The bill also requires the speaker of the house of representatives and the senate president to appoint liaisons from the house and senate, who will provide information on legislative intent if requested by the supreme court

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT requiring the supreme court to notify the legislature of any pending cases or matters before the court which involve constitutional issues regarding current law or pending legislation.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Notification to Legislature of Constitutional Issues Regarding Current Law or Pending Legislation. Amend RSA 490 by inserting after section 8-a the following new section:

490:8-b Notification to Legislature of Constitutional Issues Regarding Current Law or Pending Legislation. The clerk of the supreme court shall notify in writing the speaker of the house of representatives, the minority leader of the house of representatives, the senate president, and the minority leader of the senate of any pending case or matter before the court which involves constitutional issues regarding current law or pending legislation. Upon receipt of such notification, the speaker of the house of representatives and the senate president shall appoint liaisons from the house of representatives and the senate to provide information on legislative intent, if requested by the supreme court. The court shall admit into evidence videotapes of legislative sessions to show legislative intent.

2 Effective Date. This act shall take effect January 1, 2008.
