STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT establishing a regional license suspension hearing pilot program.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Administrative License Suspension Hearings; Cheshire County Pilot Program.

I. A regional license suspension hearing pilot program is established to conduct certain administrative license suspension hearings in Cheshire county.

II. Any person requesting an administrative license suspension hearing under RSA 263, RSA 265, or RSA 265-A may request that the hearing be held in Cheshire county. Upon receipt of such request, the director of the division of motor vehicles shall notify the person that the hearing shall be held at the Cheshire county superior court, the Keene district court, or a specified alternative site that is within ½ mile of either court.

III. The commissioner of safety shall waive any administrative rules that conflict with this section to the extent that such waiver is necessary to implement this section.

2 Pilot Program; Reports. The commissioner of safety shall report to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on the number of hearings held pursuant to section 1 of this act, costs to the department of safety associated with the hearings, and any other matters relating to the regional license suspension hearing pilot program deemed relevant by the commissioner. The report for calendar year 2008 shall be submitted by February 1, 2009 and the report for calendar year 2009 shall be submitted by February 1, 2010.

3 Repeal. The following are repealed:

I. Section 1 of this act, relative to the regional license suspension hearing pilot program.

II. Section 2 of this act, relative to pilot program reports.

4 Effective Date.

I. Paragraph I of section 3 of this act shall take effect January 1, 2010.

II. Paragraph II of section 3 of this act shall take effect February 1, 2010.

III. The remainder of this act shall take effect January 1, 2008.

HB 535-FN - FISCAL NOTE

AN ACT establishing a regional license suspension hearing pilot program.

FISCAL IMPACT:

      The Department of Safety states this bill may increase state highway fund expenditures by in indeterminable amount in FY 2008 and each year thereafter. This bill will have no fiscal impact on state, county and local revenue or county and local expenditures.

METHODOLOGY:

    The Department of Safety states this bill establishes a regional license suspension hearing pilot program allowing persons to request their hearings be held in Cheshire county beginning January 1, 2008. Although this bill does not establish any new positions or appropriate funds, the Department states that implementing this bill will require the cost of one hearing examiner (labor grade 31) and the cost of leasing and operating a hearings office in Keene. Assuming a starting salary at minimum, annual steps, and benefits at 48.3% of salary, the estimated fiscal impact is as follows:
