STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to requiring reimbursement of search and rescue costs of the fish and game department.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Search and Rescue Operations; Authority to Require Reimbursement of Costs. Amend RSA 206:26 by inserting after paragraph XII the following new paragraph:

XII-a. To require persons needing the department’s search and rescue operations due to being lost or injured, paid for by the department pursuant to RSA 206:42, to reimburse the search and rescue fund for the reasonable cost of such operations. Any cost determined to be less than $2,000 shall not require proof of negligence.

2 Effective Date. This act shall take effect January 1, 2008.

FISCAL IMPACT:

    The Office of Legislative Budget Assistant is unable to complete a fiscal note for this bill as it is awaiting information from the Department of Fish and Game. When completed, the fiscal note will be forwarded to the House Clerk's Office.
