STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to educational accountability programs.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; School Performance and Accountability; Reports Required. Amend RSA 193-H by inserting after section 5 the following new section:

193-H:6 Reports Required.

I. No later than July 1, and every year thereafter, the school board of every school district shall submit to the commissioner of the department of education a written report which shall include an accounting of all funds received under the No Child Left Behind Act, in what amounts such funds were disbursed by the school district, how each school district expends such funds, including specific programs created or maintained, or other purposes for which such funds were used, and an evaluation of the efficiency of such program.

II. No later than November 1, and every year thereafter, the commissioner of the department of education shall annually submit to the speaker of the house of representatives, the president of the senate, the governor, and the state library, a written report detailing the department’s activities in administering the No Child Left Behind Act. The report shall address any amendments to the No Child Left Behind Act and how such amendments will affect the department’s activities in administering the law.

2 Committee Established. There is established a committee to study the establishment of a state education accountability program.

3 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) Three members of the senate, appointed by the president of the senate.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

4 Duties. The committee shall study the establishment of a state education accountability program and suggest future legislation which may be necessary.

5 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Four members of the committee shall constitute a quorum.

6 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2007.

7 Effective Date. This act shall take effect upon its passage.

HB 642 FISCAL NOTE

AN ACT relative to educational accountability programs.

FISCAL IMPACT:

      The Department of Education states this bill will increase state general fund expenditures by $130,626 in FY 2008, $136,495 in FY 2009, $142,743 in FY 2010, and $149,103 in FY 2011. There will be no fiscal impact on state, county, and local revenue or county and local expenditures.

METHODOLOGY:

    The Department of Education states this bill requires the Department to prepare an annual report regarding the Department’s activities in administering the No Child Left Behind Act (NCLB). The Department states it presently prepares a variety of reports related to NCLB, including the annual Consolidated State Performance Report (Part One due in December, Part Two due in February); however, the report required by this bill would have a different scope than reports the Department currently prepares. The Department states it will need an additional Planning Analyst position to compile the data required by this bill and an additional Systems Development Specialist VI position to manage financial data and integrate programmatic data. This bill does not establish any additional positions or appropriate funds to support additional positions. The Department calculated the cost of the two additional positions as follows:
