AN ACT relative to certain data used for workers’ compensation rates.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to certain data used for workers’ compensation rates.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Data Used to Calculate Rates. Amend RSA 281-A by inserting after section 6 the following new section:

281-A:6-a Data Used to Calculate Rates to be Reviewed. The commissioner shall not allow any insurance carrier to use actuarial tables to calculate rates affecting “classes and codes” and premiums to be paid by employers, that are provided by the National Council on Compensation Insurance (NCCI) or any other source unless the data has been officially analyzed and reviewed within 7 years and has been reviewed and approved by the commissioner.

2 Effective Date. This act shall take effect 60 days after its passage.
