AN ACT relative to per pupil funding for charter school pupils.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Charter Schools; Funding. Amend RSA 194-B:11, I(a) to read as follows:

(a) For the fiscal year beginning July 1, [2006, $3,598] 2007, $4,000 annual tuition.

2 Effective Date. This act shall take effect upon its passage.

HB 752 FISCAL NOTE

AN ACT relative to per pupil funding for charter school pupils.

FISCAL IMPACT:

      The Department of Education states this bill, as amended by the House (Amendment #2007-0339h), will increase state education trust fund expenditures by $116,216 in FY 2008, $162,711 in FY 2009, $188,714 in FY 2010, and $208,640 in FY 2011. There will be no fiscal impact on state, county, and local revenue or county and local expenditures.

METHODOLOGY:

    The Department of Education states this bill increases state tuition payments to charter schools beginning in FY 2008. Under existing law, the charter school tuition rate in FY 2008 will be $3,706, which the Department calculated by adjusting the FY 2007 rate using consumer price index data consistent with RSA 194-B:11, I(b). This bill increases the FY 2008 charter school tuition rate to $4,000. The Department’s estimates of charter school tuition rates in FY 2009, FY 2010, and FY 2011 under both existing law and under this bill are based on the assumption that rates will increase 3.6% annually when adjusted for changes in the consumer price index. The Department states it is difficult to make projections for charter school enrollment in future years since the Board of Education continues to approve charter schools that usually open one or two years later, and two charter schools have closed. Pursuant to RSA 198:42, IV, charter school tuition payments are funded by the education trust fund regardless of the balance of funds available in the education trust fund.
