STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT excluding noise violations from the crime of disorderly conduct.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Breaches of the Peace; Disorderly Conduct. RSA 644:2, III is repealed and reenacted to read as follows:

III. He purposely causes a breach of the peace, public inconvenience, annoyance or alarm, or recklessly creates a risk thereof, by:

(a) Disrupting the orderly conduct of business in any public or governmental facility; or

(b) Disrupting any lawful assembly or meeting of persons without lawful authority.

2 Repeal. RSA 644:2, III-a, relative to action by a law enforcement officer to abate noise, is repealed.

3 Effective Date. This act shall take effect January 1, 2008.
