STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT establishing a commission to prepare a master plan for Mount Sunapee state park, Sunapee state beach, Pillsbury state park, Wadleigh state park, Rollins state park, and Winslow state park.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; Sunapee and Kearsarge Regional State Parks Master Plan Commission. Amend RSA by inserting after chapter 216-J the following new chapter:

CHAPTER 216-K

SUNAPEE AND KEARSARGE REGIONAL STATE PARKS

MASTER PLAN COMMISSION

216-K:1 Commission Established. There is hereby established a Sunapee and Kearsarge regional state parks master plan commission to assist the division of parks and recreation of the department of resources and economic development in creating and implementing a master plan for Mount Sunapee state park, Sunapee state beach, Pillsbury state park, Wadleigh state park, Rollins state park, and Winslow state park. The master plan shall include a vision for the future of these parks as essential public trust resources, valued and cherished by the people of the region and the state for their natural, historic, recreational, spiritual, and economic resources. The goal of the master plan will be to engage local communities and the people of New Hampshire in a process that brings forth a common vision and plan for protecting, appreciating, and promoting these critically important parks and the treasured public trust resources contained therein.

216-K:2 Membership; Administration.

I. The members of the commission shall be as follows:

(a) Two members representing the Upper Valley/Lake Sunapee Regional Planning Commission, appointed by the board of such organization.

(b) One member from the towns of Newbury, Goshen, Sunapee, Washington, Sutton, Warner, and Wilmot, appointed by the selectmen of each town.

(c) One member representing the Lake Sunapee Region Chamber of Commerce, appointed by the board of directors.

(d) Two members of the general public, appointed by the governor.

(e) The commissioner of the department of resources and economic development, or designee.

II. The appointed members shall serve one 3-year term. Vacancies shall be filled for the unexpired term in the same manner as the original appointment.

III. The commission shall annually elect one of its members as a chairperson, one as a vice-chairperson, and one as secretary-treasurer. The commission shall meet at least quarterly, with a quorum of at least 5 members, to conduct any business relevant to the purposes of this chapter.

IV. The division of parks and recreation shall provide administrative assistance to the commission as necessary for the commission to discharge its responsibilities.

216-K:3 Powers and Duties of the Commission. The commission shall:

I. No later than September 30, 2008, prepare and publish a master plan for Mount Sunapee state park, Sunapee state beach, Pillsbury state park, Wadleigh state park, Rollins state park, and Winslow state park.

II. Advise the state every 6 months on the status of the implementation of the master plan.

III. Assist the state, towns, or conservation land trusts in acquiring lands and rights in lands, to ensure a consistent management of the master plan.

IV. Assist the towns to develop building and zoning code language that complements the goals of the master plan.

V. Provide advice and counsel to the state on proposed land use developments and capital projects for consistency with the master plan.

VI. Consult with Mount Sunapee regional businesses and residents to promote the master plan.

216-K:4 Gifts, Grants, or Donations. The commission may solicit, accept, and expend any gifts, grants, donations, or other funds from any source for the development and implementation of the master plan. The commission shall deposit any such funds received in the Sunapee and Kearsarge regional state parks master plan fund established in RSA 216-K:5.

216-K:5 Sunapee and Kearsarge Regional State Parks Master Plan Fund. There is hereby established in the office of the state treasurer a fund to be known as the Sunapee and Kearsarge regional state parks master plan fund which shall be kept separate and distinct from all other funds and shall be continually appropriated to the commission. Such fund shall be nonlapsing and shall be the depository of all gifts, grants, donations, or other funds from any source for the commission pursuant to RSA 216-K:4. Master plan implementation expenses, incidental expenses of the commission, or any employees of the commission shall be paid from such fund.

2 New Subparagraph; Application of Receipts; Sunapee and Kearsarge Regional State Parks Master Plan Fund. Amend RSA 6:12, I(b) by inserting after subparagraph (252) the following new subparagraph:

(253) Funds deposited in the Sunapee and Kearsarge regional state parks master plan fund established in RSA 216-K:5.

3 Effective Date. This act shall take effect upon its passage.
