STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Seven

AN ACT relative to state reimbursement to sheriffs’ departments for the costs associated with court bailiffs.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Fees of Sheriffs and Deputy Sheriffs; State Reimbursement of Costs Associated With Court Bailiffs. RSA 104:31, X is repealed and reenacted to read as follows:

X. The state shall reimburse the sheriff's office, within available funds appropriated by the legislature, $20 for each hour worked, plus all traveling expenses, including mileage at the same rate as state employees to attend any official business, for any person employed as a bailiff by the sheriff's office. The state shall also reimburse the sheriff’s office for the costs of ammunition for such bailiffs. The state shall reimburse the counties, within available funds appropriated by the legislature, for all costs associated with employing court bailiffs, if those costs are the result of job requirements imposed by federal and state governments.

2 Effective Date. This act shall take effect July 1, 2007.

HB 910-FN - FISCAL NOTE

AN ACT relative to state reimbursement to sheriffs’ departments for the costs associated with court bailiffs.

FISCAL IMPACT:

      The Department of Administrative Services has determined this bill will increase state general fund expenditures and county revenue by $3,426,070 in FY 2008 and each year thereafter. There will be no fiscal impact on county and local expenditures or state and local revenue.

METHODOLOGY:

    The Department states this bill increases the reimbursement to counties for costs associated with employing sheriffs as court bailiffs from $65 for each full day to $20 an hour. This bill would also reimburse sheriff’s offices for the costs of ammunition for such bailiffs. The Department states the vast majority of reimbursements for sheriffs are for full days, and reimbursements for those full days would increase by 146%. The Department assumes an 8 hour work day increasing the cost from $65 a day to $160 (8 hours * $20 an hour). The average cost of benefits, including FICA and Workers Comp. is 12% of the per day rate.

    The FY 2007 budget contains a total of $2,335,500 of general funds for sheriff reimbursements, including $2,085,268 for per diem costs and $250,232 for benefits. Part of this is budgeted in the Department of Administrative Services ($1,093,000 of general funds for sheriff reimbursements, including $975,893 for per diem costs and $117,107 for benefits) and part in the Judicial Branch ($1,242,500 of general funds for sheriff reimbursements, including $1,109,375 for per diem costs and $133,125 for benefits). The Department determined annual per day costs will increase under this bill by $3,044,491 (1.46 x $2,085,268) and annual benefit costs will increase by $365,339 [(.12 x $5,129,759) - $250,232], resulting in a total annual increase in general fund expenditures of $3,409,830 ($3,044,491 + $365,339). Annual county revenue would therefore increase by $3,409,830.

    The Department states the approximately 290 working in court security statewide would need to undergo firearm qualification twice a year, expending 250 rounds of ammunition each time for a total of 500 rounds per person per year. Based on the average cost of the three most popular types of standard ammunition (40 caliber, 45 caliber, and 9 millimeter), it is estimated

    it will cost $56 per bailiff for ammunition, for a yearly total of $16,240. Ammunition prices are based on the state contract price for ammunition, which expires in February of 2007. State general fund expenditures would increase by $16,240 and county revenue would increase by $16,240.
