STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT repealing a fee charged by the registry of deeds.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Repeal. The following are repealed:

I. RSA 478:17-g, I-a, relative to the fee charged by the registry of deeds for deposit in the land and community heritage investment program.

II. RSA 78-B:8, III, relative to administration of the fee by the commissioner of revenue administration.

III. 2007, 263:47, relative to the appropriation to the department of revenue administration for administrative costs associated with collection of the fee.

IV. 2007, 263:48, relative to prospective repeal of the fee on July 1, 2018.

2 Effective Date. This act shall take effect 60 days after its passage.

SB 304-FN-LOCAL - FISCAL NOTE

AN ACT repealing a fee charged by the registry of deeds.

FISCAL IMPACT:

The Department of Revenue Administration, the New Hampshire Association of Counties, and the Land and Community Heritage Program state this bill will decrease state general fund expenditures by $50,000 in FY 2009 and decrease state restricted revenue, county revenue and county expenditures by an indeterminable amount in FY 2009 and each year thereafter. There is no fiscal impact on local expenditures or revenue.

METHODOLOGY:

The Department of Revenue Administration, the New Hampshire Association of Counties, and the Land and Community Heritage Program indicate this bill will repeal the fee charged by the registry of deeds for deposit in the land and community heritage investment program. The bill also repeals the $50,000 appropriation to the Department of Revenue Administration for administrative costs and the July 1, 2018 prospective repeal of the fee. Chapter 263, Laws of 2007 provides that if no other dedicated funding source is identified for the land and community heritage investment program, a surcharge of $25 will be assessed for each recording at the registry of deeds effective July 1, 2008. The registry of deeds would retain 4 percent of the total surcharges collected as payment for the service of collecting the surcharge. The balance of funds would be remitted to the Department of Revenue Administration and subsequently deposited in the trust fund for the land and community heritage investment program. The Department of Revenue states this bill will decrease state expenditures by $50,000. The Land and Community Heritage Investment Program states this bill may decrease restricted revenue by approximately $6 million. The New Hampshire Association of Counties states this bill will decrease county expenditures and revenue by an indeterminable amount.
