STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to increasing the staff of the charitable trust unit of the department of justice and making an appropriation therefor.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Department of Justice; Charitable Trust Unit Staff Increased. In order to facilitate the state's review and analysis of ever increasingly complex filings with the charitable trust unit, and further in order to protect the charitable purpose of organizations required to file with the charitable trust unit, the department of justice, charitable trust unit, shall have the authority to hire a full-time financial analyst at labor grade 28.

2 Appropriation. The sum of $1 for the fiscal year ending June 30, 2009 is hereby appropriated to the department of justice for funding the additional staff position within the charitable trust unit as provided in section 1 of this act. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

3 Effective Date. This act shall take effect July 1, 2008.

SB 448-FN-A - FISCAL NOTE

AN ACT relative to increasing the staff of the charitable trust unit of the department of justice and making an appropriation therefor.

FISCAL IMPACT:

The Department of Justice states this bill will increase state restricted expenditures by $77,240 in FY 2009, $78,804 in FY 2010, $82,302 in FY 2011, and $85,918 in FY 2012. There will be no fiscal impact on county and local expenditures or state, county, and local revenue.

This bill appropriates $1.00 from the state general fund in FY 2009 to the Department of Justice for the purposes of this bill.

METHODOLOGY:

The Department of Justice states this bill will authorize the Department to hire a financial analyst for the charitable trust unit and appropriates a $1.00 for this purpose. The Department estimates the following expenditures with the addition of this position:

The Department states for the past two years the fees collected by the charitable trust unit have been more than its expenditures. The Department expects fees collected by the charitable trust unit will be sufficient to cover the entire cost of the financial analyst position.
