AN ACT requesting that the attorney general seek a ruling from the supreme court relative to whether New Hampshire may opt out of enforcing the provisions of the Master Settlement Agreement.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eight
AN ACT requesting that the attorney general seek a ruling from the supreme court relative to whether New Hampshire may opt out of enforcing the provisions of the Master Settlement Agreement.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Master Settlement Agreement. The general court hereby requests that the attorney general seek a ruling from the New Hampshire supreme court relative to:
I. Whether the state of New Hampshire may legally opt out of enforcing the provisions of the Master Settlement Agreement under RSA 541-C and RSA 541-D.
II. What recourse participating manufacturers would have regarding prior payments made to the state, if New Hampshire opts out of enforcing the provisions of the Master Settlement Agreement.
2 Effective Date. This act shall take effect upon its passage.
