STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to authorizing temporary registrations of off-highway recreational vehicles for nonresidents.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 OHRV Registrations. Amend RSA 215-A:21, II to read as follows:

II. Except as otherwise provided, no OHRV shall be operated in this state unless registered as provided in this chapter. No registration shall be required for an OHRV operated solely on land owned or leased by the owner of the OHRV. Except for temporary registrations under paragraph V, all OHRV registrations shall expire on July 1 in each year. The executive director shall collect a fee for each registration as provided in RSA 215-A:23.

2 Temporary Registrations. Amend RSA 215-A:21, V to read as follows:

V. All OHRVs except conventional motor vehicles registered for highway use [and those registered pursuant to paragraph IV] shall be registered at the fee provided in RSA 215-A:23, and shall be furnished a registration plate or decals of a design and color as chosen by the executive director. Said registration plate or decals shall be attached securely on the front and rear of the vehicle, in an unobstructed manner, as high as possible or at a location designed by the manufacturer. A nonresident registering an OHRV for a 5-day period shall be issued a temporary registration by the executive director. The executive director shall determine the design, color, and placement of temporary registration decals. Temporary registrations may not be transferred.

3 New Paragraph; Fees; Temporary Registration. Amend RSA 215-A:23 by inserting after paragraph V the following new paragraph:

V-a. Temporary Registration for Nonresidents -- $32 for each non-transferable, 5-day registration upon presentation of a valid out-of-state driver's license issued to a person 18 years of age or older. From each fee collected pursuant to this paragraph:

(a) The first $18 shall be appropriated to the department of resources and economic development for administration of the bureau's grant-in-aid program pursuant to paragraph VI.

(b) From the balance, $7 shall be appropriated to the department of resources and economic development for administration of the bureau for the purposes listed in paragraph VII, and $7 shall be appropriated to the department of fish and game for the purposes listed in paragraph VIII.

4 Effective Date. This act shall take effect January 1, 2009.

SB 503-FN - FISCAL NOTE

AN ACT relative to authorizing temporary registrations of off-highway recreational vehicles for nonresidents.

FISCAL IMPACT:

The Department of Resources & Economic Development states this bill may decrease state restricted revenue by $50,683 in FY 2009 and an indeterminable amount in each fiscal year thereafter. The Fish & Game Department states this bill will increase state restricted expenditures by $17,956 in FY 2009 and each fiscal year thereafter, and will have an indeterminable impact on state restricted revenue in FY 2009 and each fiscal year thereafter. There will be no fiscal impact on county and local revenue and expenditures.

METHODOLOGY:

The Department of Resources & Economic Development (DRED) assumes all non-resident OHRV registrations would change to the proposed 10-day temporary registration, for which DRED would receive $25 from every registration ($18 for grant-in-aid and $7 for administration). DRED assumed there would be 3,231 non-resident ATVs and 1,005 non-resident trail bikes registered annually when developing its FY 2008/FY 2009 operating budget. DRED currently receives $39.10 per ATV registration ($22 for grant-in-aid and $17.10 for administration) and $30.10 per trail bike registration ($13 for grant-in-aid and $17.10 for administration). Current annual budgeted revenue is $156,583 [(3,231 x $39.10) + (1,005 x $30.10)]. Assuming all non-residents choose the 10-day registration option, annual revenue to DRED would be $105,900 [(3,231 x $25) + (1,005 x $25)], a decrease of $50,683 in annual restricted revenue ($156,583 - $105,900).

The Fish & Game Department estimates it will incur annual costs of approximately $17,956 to create registration decals and certificates that are different from the permanent annual registrations, including $5,300 for decals, $281 for registration certificates, and $12,375 in computer programming from the Office of Information Technology.

The Fish & Game Department currently receives $30.90 for each non-resident trail bike or ATV registration, for total anticipated annual revenue of $130,892 (4,236 x $30.90). Under this bill, the Department would receive $7.00 for each temporary non-resident registration. If all non-residents were to purchase only the temporary registration, annual revenue would be $29,652 (4,236 x $7.00), a decrease of $101,240. The Department states it is unlikely non-residents would choose to purchase both temporary and regular registrations, which would increase restricted revenue to the department by $29,652.
