STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT restricting the number of puppies to be sold by commercial kennels.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Restriction on Sale of Puppies. Amend RSA 466:6 by inserting after paragraph V the following new paragraph:

VI. No group license, as defined under RSA 466:6, shall be issued or renewed to any entity which sells or transfers 20 or more litters in any 12-month period or sells or transfers 100 or more puppies in any 12-month period. This paragraph shall not apply to animal shelter facilities as defined under RSA 437:2, I, nor any person or animal care center providing care for an abandoned animal, as defined under RSA 437:18, IV.

2 Restriction on Sale of Puppies. Amend RSA 437:7 to read as follows:

437:7 Exception.

I. The license provisions of this subdivision shall not apply to breeders of dogs licensed under the provisions of RSA 466:6; veterinarians; owners and operators of horse riding stables; and auctioneers, breeders, or keepers of farm livestock.

II. No license shall be issued or renewed to a commercial kennel, as defined under RSA 466:4, III and 437:2, I-a, which sells or transfers 20 or more litters in any 12-month period or sells or transfers 100 or more puppies in any 12-month period. This paragraph shall not apply to animal shelter facilities, as defined in RSA 437:2, I, nor any person or animal care center providing care for an abandoned animal, as defined under RSA 437:18.

3 Effective Date. This act shall take effect 60 days after its passage.

SB 504-FN - FISCAL NOTE

AN ACT restricting the number of puppies to be sold by commercial kennels.

FISCAL IMPACT:

The Department of Agriculture states this bill may decrease state revenue by an indeterminable amount in FY 2008 and each year thereafter. There will be no fiscal impact on county and local revenue or state, county, and local expenditures.

METHODOLOGY:

The Department of Agriculture states this bill prohibits the issuing of a license to commercial kennels that sell or transfer 20 or more litters or 100 or more puppies. The Department indicates there are approximately 100 licensed pet shops that sell at least 100 dogs a year. The license fee is $200 annually. The Department assumes 50 of the pet shops may be impacted by this bill and go out of business. This would result in state revenue decreasing by $10,000 (50 licensed pet shops * $200 per license) in FY 2008 and each year thereafter. The Department also suggests business profit tax revenue may be impacted by the closure of pet shops.
