STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to the moratorium on certain nursing home beds.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Intermediate Care Facility Beds; Moratorium Lifted. Notwithstanding RSA 151-C:4, III(a) or any other law to the contrary, from the effective date of this act through the period ending June 30, 2008, the health services planning and review board may authorize changes regarding the licensure or certification of any intermediate care facility beds in any type of facility, may authorize the addition of any intermediate care facility beds in any type of facility, and may grant a certificate of need related to the board’s administrative standards for comprehensive intermediate care facility services.

2 Effective Date. This act shall take effect upon its passage.

SB 505-FN - FISCAL NOTE

AN ACT relative to the moratorium on certain nursing home beds.

FISCAL IMPACT:

The Department of Health and Human Services states this bill may have an indeterminable fiscal impact on state and county expenditures in FY 2008. This bill will have no fiscal impact on state, county, and local revenue, or local expenditures.

METHODOLOGY:

The Department states the fiscal impact of this bill can not be determined as there is no way of knowing how many new nursing home beds would be added by the nursing home industry if the moratorium is removed. For FY 2007 the average Medicaid expenditure for each nursing home bed was $69,221 ($189.65 daily rate X 365 days) for the combined initial Medicaid rate, supplemental Medicaid Quality Incentive Program (MQIP) rate, and provider payment expenses. In FY 2008 these expenditures are funded by 50% federal funds, 25% state funds, and 25% county funds. The effective date of this bill is upon passage through June 30, 2008. The exact fiscal impact cannot be determined at this time.
