STATE OF NEW HAMPSHIRE

AN ACT relative to fees for terrain alteration permits.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Terrain Alteration Permit Fees. Amend RSA 485-A:17, II to read as follows:

II. The department shall charge a fee for each review of plans, including project inspections, required under this section. The fee shall be based on the extent of contiguous area to be disturbed. Except for RSA 483-B:9, the fee for plans encompassing an area of at least 100,000 square feet but less than 200,000 square feet shall be [$1,250] $500. For the purposes of RSA 483-B:9, the fee for plans encompassing an area of at least 50,000 square feet but less than 200,000 square feet shall be [$1,250] $500. An additional fee of [$500] $200 shall be assessed for each additional area of up to 100,000 square feet to be disturbed. No permit shall be issued by the department until the fee required by this paragraph is paid. All fees required under this paragraph shall be paid when plans are submitted for review and shall be deposited in the terrain alteration fund established in paragraph II-a.

2 Effective Date. This act shall take effect July 1, 2008.

SB 510-FN-A - FISCAL NOTE

AN ACT relative to fees for terrain alteration permits.

FISCAL IMPACT:

The Department of Environmental Services states this bill will decrease state restricted revenue and expenditures by $476,606 and increase state general fund expenditures by $476,606 in FY 2009 and each fiscal year thereafter. There will be no fiscal impact on county and local revenues and expenditures.

METHODOLOGY:

The Department of Environmental Services states this bill decreases fees for Alteration of Terrain (AoT) permits from $1,250 to $500 for plans encompassing an area of up to 200,000 square feet, and decreases the fee for each additional 100,000 square feet from $500 to $200. The fee change would be effective July 1, 2008 (FY 2009), and would reduce the fees to the levels they were at prior to July 1, 2007. The Department states it anticipates $794,343 in restricted revenue from the current fees in FY 2008, which is dedicated to cover expenditures associated with the AoT program, including staff salaries and benefits. Since the fees contained in this bill are 40% of the current fees, the Department expects annual fee revenue in FY 2009 and subsequent fiscal years will be 40% of anticipated FY 2008 revenue (40% x $794,343 = $317,737), for an annual decrease in restricted revenue of $476,606 ($794,343 – $317,737 = $476,606). The Department assumes that because the reduction of restricted revenue would result in total restricted revenue in the AoT fund that is not sufficient to support program expenses required to meet statutory timeframes for the review and approval of permits, state general fund expenditures will increase by $476,606 in FY 2009 and each fiscal year thereafter to cover AoT program costs.
