AN ACT relative to access to case records of the department of health and human services.

ANALYSIS

This bill permits welfare and law enforcement agencies from other states to access case records of the department of health and human services in order to carry out their child protection responsibilities.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to access to case records of the department of health and human services.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraph; Department of Health and Human Services; Access to Case Record. Amend RSA 170-G:8-a, II(a) by inserting after subparagraph (8) the following new subparagraph:

(9) Another state’s child welfare agency, law enforcement agency, or other government entity that requires the information in order to carry out its responsibility under law to protect children from abuse or neglect.

2 Effective Date. This act shall take effect 60 days after its passage.
