STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing a committee to study health care services in correctional facilities and the issue of access to inmates by medical care, mental health care, and substance abuse treatment providers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

153:1 Committee Established. There is established a committee to study health care services in correctional facilities and the issue of access to inmates by medical care, mental health care, and substance abuse treatment providers.

153:2 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) Five members of the house of representatives, appointed by the speaker of the house of representatives as follows:

(1) One member from the children and family law committee.

(2) One member from the finance committee.

(3) One member from the health, human services and elderly affairs committee.

(4) One member from the criminal justice and public safety committee.

(5) One member from the house judiciary committee who is an attorney.

(b) One member of the senate, appointed by the president of the senate.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

153:3 Duties. The committee shall:

I. Review the standards of health care provided to inmates in state and county correctional facilities and municipal jails, and to children in juvenile detention facilities, including the issue of access to inmates or children by health care, mental health care, or substance abuse treatment services providers.

II. Study the provision of health care, mental health care, and substance abuse treatment services provided to inmates in state and county correctional facilities and municipal jails, and to children in juvenile detention facilities.

III. Consult, as needed, with experts and other professionals with relevant knowledge or expertise to assist in carrying out the committee’s objective.

153:4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Four members of the committee shall constitute a quorum.

153:5 Report. The committee shall make an annual report on its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1 of each year.

153:6 Repeal. Sections 1-5 of this act, establishing a committee to study health care services in correctional facilities and the issue of access to inmates by medical care, mental health care, and substance abuse treatment providers, are repealed.

153:7 Effective Date.

I. Section 6 of this act shall take effect November 2, 2012.

II. The remainder of this act shall take effect upon its passage.
