AN ACT relative to workers’ compensation for death.

ANALYSIS

Under this bill, if an employee dies on the job and the employee does not have any dependents, the estate of the deceased employee would be entitled to a certain amount of money in addition to burial expenses.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to workers’ compensation for death.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraphs; Workers’ Compensation; Compensation for Death. Amend RSA 281-A:26 by inserting after paragraph VII the following new paragraphs:

VIII. The estate of a deceased employee who dies without dependents, widow, or widower shall be paid $25,000 in addition to burial expenses as provided in paragraph IV.

IX. The estate of a deceased employee who dies without dependents, widow, or widower may proceed against the employer in an action for wrongful death if the estate waives the benefits of this chapter.

2 Effective Date. This act shall take effect January 1, 2010.

HB 240-FN - FISCAL NOTE

AN ACT relative to workers’ compensation for death.

FISCAL IMPACT:

    The Department of Labor states this bill will increase state, county, and local expenditures by an indeterminable amount in FY 2010 and each year thereafter. There will be no fiscal impact on state, county, and local revenues.

METHODOLOGY:

    The Department of Labor states this bill will entitle the estate of an employee that does not have any dependents to be paid $25,000 in addition to burial expenses, in the event the employee dies on the job. The Department states this bill will increase state, county, and local expenditures by an indeterminable amount. The Department states no estimate of the fiscal impact can be prepared as it is unknown if there would be a work related death and if a work related death were to occur, it is unknown whether or not the employee would have dependents.
