STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nine
AN ACT relative to workers’ compensation for death.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Workers' Compensation; Compensation for Death. Amend RSA 281-A:26, IV to read as follows:
IV. The employer shall pay burial expenses not to exceed [$5,000] $10,000.
2 Effective Date. This act shall take effect January 1, 2010.

HB 240 FISCAL NOTE
AN ACT relative to workers’ compensation for death.
FISCAL IMPACT:
The Department of Labor states this bill, as amended by the House (Amendment #2009-0427h), will increase state, county, and local expenditures by an indeterminable amount in FY 2010 and each year thereafter. There will be no fiscal impact on state, county, and local revenues.
METHODOLOGY:
The Department of Labor states this bill will increase the burial expense from $5,000 to $10,000 in the event an employee dies as a result of a workers’ compensation injury. The Department is not able to predict the number of work related deaths of a state, county, or local employee. The Department states there are approximately 6 compensable deaths a year with the deaths occurring in both the private and public sectors.
