STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nine
AN ACT relative to public employees’ right to strike.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Non-Emergency Public Employees. Amend RSA 273-A:1 by inserting after paragraph VII the following new paragraph:
VII-a. “Non-emergency public employees” means all public employees except those engaged in work as nurses, doctors, firefighters, emergency medical technicians, police officers, corrections officers, and those performing services required by an emergency related to homeland security during the course of an emergency.
2 Strikes Permitted; Non-emergency Public Employees Only. Amend RSA 273-A:13 to read as follows:
273-A:13 Strikes [Prohibited].
I. Strikes and other forms of job action by emergency public employees are hereby declared to be unlawful. A public employer shall be entitled to petition the superior court for a temporary restraining order, pending a final order of the board under RSA 273-A:6 for a strike or other form of job action in violation of the provisions of this chapter, and may be awarded costs and reasonable legal fees at the discretion of the court.
II. Strikes and other forms of job action by non-emergency public employees are lawful.
3 Effective Date. This act shall take effect 60 days after its passage.
