STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT permitting a person to record a law enforcement officer in the course of such officer’s official duties.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraph; Wiretapping and Eavesdropping; Interception and Disclosure. Amend RSA 570-A:2, II by inserting after subparagraph (l) the following new subparagraph:

(m) Any person to make an audio recording, video recording, or both, of a law enforcement officer in the course of such officer’s official duties, provided that the person making the recording shall first give notification of the recording to the officer.

2 Effective Date. This act shall take effect January 1, 2010.
