This bill provides that a recipient of public assistance effectively assigns his or her right to child support to the department of health and human services for the period of time that public assistance is provided.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nine
AN ACT relative to the assignment of right of child support enforcement.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Assignment of Right of Support Enforcement. Amend RSA 161-C:22, I to read as follows:
I. The receipt of public assistance for a child shall constitute an assignment by the recipient to the department of any and all rights, title, and interest in and to support obligation owed to or for the recipient or, the child or children, or both the recipient and any child or children, up to the amount of public assistance money paid for or on behalf of such child or such children[, including any support unpaid at the time of assignment as long as public assistance is paid] which accrues during the period that the public assistance is provided. Such assignment includes only those arrearages which accrue during the period that the public assistance is provided to the family.
2 Effective Date. This act shall take effect October 1, 2009.

HB 313-FN - FISCAL NOTE
AN ACT relative to the assignment of right of child support enforcement.
FISCAL IMPACT:
The Department of Health and Human Services states this bill may decrease state revenue and expenditures by an indeterminable amount in FY 2009 and each year thereafter. This bill will have no fiscal impact on county and local revenue or expenditures.
METHODOLOGY:
The Department of Health and Human Services states cases affected by this bill would be those few that have an arrearage due when the case is initiated that is in excess of the TANF (Temporary Assistance to Needy Families) received at that time. The Department would lose the rights to that excess. This bill could also reduce a family’s TANF grant depending upon the amount of arrearages collected in the case. The exact fiscal impact is indeterminable at this time.
