STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing a commission to study recycling of unused controlled drugs in long-term care facilities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study recycling of unused controlled drugs in long-term care facilities.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Three members of the house of representatives, one of whom shall be from the house health, human services and elderly affairs committee, appointed by the speaker of the house of representatives.

(b) One member of the senate, appointed by the president of the senate.

(c) The commissioner of the department of health and human services, or designee.

(d) The commissioner of the department of environmental services, or designee.

(e) A member of the pharmacy board , appointed by the president of the board.

(f) An administrator of a long-term care facility, appointed by the governor.

(g) A consultant pharmacist for long-term care facilities, appointed by the governor.

(h) Three public members knowledgeable in the areas of controlled drugs in long-term care facilities, appointed by the governor.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties. The commission’s study shall include, but not be limited to:

I. Current practices for disposal of controlled substances in long-term care facilities and whether such drugs may be safely recycled for another person’s use.

II. The environmental impact of disposing of controlled drugs into sewage systems.

4 Chairperson; Quorum. The members of the study commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Five members of the commission shall constitute a quorum.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2009.

6 Effective Date. This act shall take effect upon its passage.
