STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to use of weights and measurements at farmers markets.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Farmers’ Markets and Residential Kitchens; Exemption. Amend RSA 438 by inserting after section 45 the following new section:

438:46 Farmers’ Markets and Residential Kitchens; Exemption. Farmers’ markets, as defined by RSA 21:31-a, and sales of products amounting to less than $1000 per day by persons operating residential kitchens, including sales of baked items, double crusted fruit pies, candy, fudge, acidic foods including vinegars and mustards, and jams and jellies, shall be exempt from this chapter.

2 Effective Date. This act shall take effect 60 days after its passage.
