AN ACT limiting the filing of petitions for trust accountings.

ANALYSIS

This bill limits the filing of petitions for trust accountings by beneficiaries of trusts. The bill also requires a party filing a petition for a trust accounting which is determined by the probate court to be frivolous to pay attorney’s fees and court costs for all parties to the proceeding.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT limiting the filing of petitions for trust accountings.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Probate Court Proceedings; Requests for Trust Accountings. Amend RSA 547 by inserting after section 3-l the following new section:

547:3-m Requests for Trust Accountings. If a trust stipulates that there shall be no inquiry or challenge by any beneficiary during the lifetime of the owner of the trust, there shall be no requests for trust accountings by beneficiaries during the lifetime of the owner. Any party filing a petition for a trust accounting which is determined to be frivolous shall pay all attorney’s fees and court costs for all parties to the trust accounting proceeding.

2 Effective Date. This act shall take effect July 1, 2009.
