AN ACT requiring sanctions against hospitals for failing to report infection rates.

This bill allows the commissioner of the department of health and human services to impose an administrative fine for each day of noncompliance upon hospitals for failure to report infection rates.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT requiring sanctions against hospitals for failing to report infection rates.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Report of Infection Rates; Administrative Fine. Amend RSA 151:33 by inserting after paragraph V the following new paragraph:

VI. In addition to other fines and penalties imposed under this chapter, the commissioner, after notice and hearing, pursuant to rules adopted under RSA 541-A, may impose an administrative fine of up to $1,000 for each day of noncompliance upon any hospital required to report infection rates under this section.

2 Effective Date. This act shall take effect January 1, 2010.
