STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing a commission to study preventing dental disease among New Hampshire’s children.

Be it Enacted by the Senate and House of Representatives in General Court convened:

130:1 Statement of Purpose. The general court recognizes that tooth decay is the most common preventable chronic childhood disease. Delayed recognition and treatment of childhood tooth decay can result in costly restorative treatment, and can affect a person’s lifelong ability to speak, thrive, learn, and work. Recent pediatric care strategies for preventing childhood tooth decay have been shown to be cost-effective and can make a significant impact on the overall health of a child.

130:2 Commission Established. There is established a commission to study preventing dental disease among New Hampshire’s children.

130:3 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Two members of the house of representatives, appointed by the speaker of the house of representatives.

(b) One member of the senate, appointed by the president of the senate.

(c) The commissioner of the department of health and human services, or designee.

(d) A representative from the New Hampshire Oral Health Coalition, appointed by that organization.

(e) A representative of the New Hampshire Dental Society, appointed by that organization.

(f) A representative of the Dental Hygiene Association, appointed by that organization.

(g) Two representatives of the New Hampshire Medical Society, one of whom shall be a pediatrician and one of whom shall be a family physician, appointed by the society.

(h) One representative of the Bi-State Primary Care Association, appointed by the association.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

130:4 Duties.

I. The commission shall study means of preventing dental disease among New Hampshire’s children by implementing prevention strategies in the primary care setting. The commission shall seek input from individuals or entities that the commission deems relevant to its study.

II. The commission’s study shall include, but not be limited to:

(a) The examination of evidence-based prevention practices from other states.

(b) The social, economic, and environmental factors affecting the oral health of children.

(c) The health consequences and economic impact of early childhood dental disease.

(d) The cost and benefits of implementing state-wide prevention strategies and policies.

III. The commission shall create an action plan for preventing dental disease, delivered in the medical primary care setting, to improve and promote oral health for children between 0 and 3 years of age who are enrolled in the New Hampshire Medicaid program. The action plan shall:

(a) Include clinical and non-clinical goals, objectives, and strategies, as well as specific tactics, responsibilities, time-frame suggestions, and resource requirements within each strategy.

(b) Identify barriers, and suggested solutions to those barriers, for each strategy.

(c) Identify existing training and communication programs that may be used to meet the goals of the commission and determine the need to establish any additional training and communication programs.

(d) Include a Medicaid reimbursement methodology.

(e) Establish metrics to measure the performance and success of the plan.

130:5 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 30 days of the effective date of this section. Six members of the commission shall constitute a quorum.

130:6 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2009.

130:7 Effective Date. This act shall take effect upon its passage.
