ANALYSIS

This bill establishes procedures for the licensure and operation of retail health clinics also known as convenient care clinics.

This bill is a result of the 2008, 227, the commission to study and develop legislation to regulate the operation of retail health clinics and limited service clinics, also known as miniclinics.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to retail health clinics.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Statement of Purpose. The general court finds that many New Hampshire citizens do not have access to affordable and convenient high quality basic health care services. Therefore, the general court hereby licenses retail health care clinics also known as convenient care clinics to allow greater access to basic health care services and to lower health costs for a limited number of health care services.

2 New Section; Retail Health Clinics or Convenient Care Clinics. Amend RSA 151 by inserting after section 2-d the following new section:

151:2-e Retail Health Clinics or Convenient Care Clinics.

I. In this section “retail health clinic” or “convenient care clinic” means a stand-alone entity or an entity located within a retail store or pharmacy which is limited to the services listed under subparagraph II(a). A retail health care clinic located in a retail store or pharmacy may be owned and operated by the retail store or pharmacy or it may be owned and operated by a third party.

II. A retail health care clinic or convenient care clinic shall be licensed in accordance with this chapter. Such a clinic shall:

(a) Provide a scope of services limited to preventative care and wellness promotion services such as physicals, blood pressure, cholesterol level and other similar tests, flu shots and other vaccinations, and routine treatment of simple, well-defined medical conditions, such as strep throat, ear and tooth infections, and urinary tract infections.

(b) Employ credentialed professional and medical staff as required under rules adopted pursuant to RSA 541-A.

(c) Post hours of operation including nearby sites at which care may be sought during hours when the clinic is not open.

(d) Post a well-defined menu of its services.

(e) Maintain a transfer agreement with a local hospital or hospitals.

(f) Ensure continuity of care by making appropriate referrals for follow up care and treatment and, with patient consent, provide medical records to other health care providers as necessary.

(g) Encourage all patients to have a medical home.

3 New Subparagraph; Rulemaking Added. Amend RSA 151:9, I by inserting after subparagraph (n) the following new subparagraph:

(o) Procedures for the operation of retail health clinics or convenient care clinics, including staff credentials.

4 Effective Date. This act shall take effect January 1, 2010.

HB 422-FN - FISCAL NOTE

AN ACT relative to retail health clinics.

FISCAL IMPACT:

      The Department of Health and Human Services states this bill will increase state revenue and expenditures by an indeterminable amount in FY 2010 and each year thereafter. There will be no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

    The Department of Health and Human Services states this bill would likely result in additional licensing revenue as retail chains establish retail health clinics in the State. The Department states it is impossible to know how many retail health clinics will be established in the State, and how much additional revenue will be generated. There will also be a cost of the State associated with the licensing, inspection, and oversight of retail health clinics. The exact fiscal impact cannot be determined at this time.
