AN ACT relative to the automated external defibrillator advisory commission.

ANALYSIS

This bill establishes meeting and quorum requirements for the automated external defibrillator advisory commission and amends the duties of the commission to be solely advisory in nature. The bill also establishes a prospective repeal date of January 1, 2014 for the commission.

This bill is a request of the automated external defibrillator advisory commission.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to the automated external defibrillator advisory commission.

Be it Enacted by the Senate and House of Representatives in General Court convened:

42:1 Meetings and Duties of the Automated External Defibrillator Advisory Commission. Amend RSA 195-I:2, III-V to read as follows:

III. The commission shall:

(a) Meet at regular times as determined by the commission.

(b) Review state policies to ensure the achievement of the purposes and policies of this chapter.

(c) Review and provide coordination strategies for public and private sector efforts and agencies to raise and appropriate funds to ensure the achievement of the purposes and policies of this chapter.

(d) [Establish accounts, and accept and administer grants, donations, and other funds received by the commission to achieve the purposes and policies of this chapter.

(e)] Publish studies and reports, and hold public seminars and educational events, regarding the need to obtain and maintain automated external defibrillators at appropriate school locations for the safety and protection of students and others participating in or attending school athletic and related activities.

[(f) Enter into agreements with state departments or agencies, and private sector organizations and persons, as it deems necessary, to implement and further the policies and purposes of this chapter.

(g)](e) Advise the general court on legislative initiatives that would further the purposes and policies of this chapter.

[(h) Perform any other tasks it deems necessary for achieving the purposes and policies of this chapter.]

IV. Members of the commission shall serve without compensation, except that legislative members shall receive mileage at the legislative rate while attending to the duties of the commission.

V. The commission shall keep written records of all its proceedings. Four members of the commission shall constitute a quorum. Members who are unable to attend a meeting of the commission may designate a proxy who shall serve as a nonvoting member of the commission for the meeting indicated by the standing member. Members whose presence is not required for a quorum may participate in meetings via telephone or video conferencing, in which case the meeting may be held in a location where such equipment is available, provided that proper notice of the meeting is also provided.

42:2 Repeal. The following are repealed:

I. RSA 195-I:3, relative to the authority of the commission to accept gifts and donations.

II. RSA 195-I:4, relative to the commission’s rulemaking authority.

III. RSA 195-I, relative to the external defibrillator commission.

42:3 Effective Date.

I. Section 2, paragraph III of this act shall take effect January 1, 2014.

II. The remainder of this act shall take effect upon its passage.
