AN ACT requiring the attorney general to request a life sentence instead of the death penalty in certain circumstances.

ANALYSIS

This bill requires that in a capital murder case where the defendant pleads guilty, the state shall not seek the death penalty, but shall instead request a sentence of life imprisonment.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT requiring the attorney general to request a life sentence instead of the death penalty in certain circumstances.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Capital Murder. Amend RSA 630:1, III to read as follows:

III. A person convicted of a capital murder may be punished by death, provided that if the defendant pleads guilty, the state shall not pursue punishment by death but shall request a sentence of life imprisonment.

2 Effective Date. This act shall take effect January 1, 2010.
