STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to the pertussis vaccine for newborns.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Duties of the Commissioner of the Department of Health and Human Services; Information on Pertussis. Amend RSA 132:2 by inserting after paragraph XI the following new paragraph:

XII. Cause to be prepared a brochure which provides information relative to pertussis and the vaccines available to prevent this disease. The brochure shall be distributed to parents of newborns prior to being discharged from the hospital or birthing center. The brochure shall include information on the causes and symptoms of pertussis, how it is transmitted, how it may be prevented by vaccination, including the benefits and possible side effects of the vaccination, and places parents may obtain the vaccine to prevent pertussis. If the department prepares the brochure, it may accept gifts, donations, and other moneys from any source for the cost of the brochure. Alternatively, the department may allow another source to prepare the brochure, provided that the department approves the content of such brochure.

2 Effective Date. This act shall take effect 60 days after its passage.

    The Legislative Budget Assistant has determined that this legislation has a total fiscal impact of less than $10,000 in each of the fiscal years 2009 through 2013.
