STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to the construction of an Old Man of the Mountain monument on the shore of Profile Lake and making an appropriation therefor.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Sections; Powers of the Governor and Council; Old Man of the Mountain Monument. Amend RSA 4 by inserting after section 9-h the following new sections:

4:9-i Construction of Old Man of the Mountain Monument Authorized.

I. There shall be a monument constructed to commemorate the falling of the Old Man of the Mountain. The monument shall be constructed on the shore of Profile Lake in Franconia State Park. The governor is authorized to accept in the name of the state the Old Man of the Mountain monument as a private gift upon its completion.

II.(a) The director of the division of parks and recreation, subject to the direction and supervision of the commissioner of the department of resources and economic development, shall act as the custodian of the Old Man of the Mountain monument, and shall have charge of all matters relating to the care, maintenance, and repair of, and additions to, the monument.

(b) The director of the division of parks and recreation, subject to the direction and supervision of the commissioner of the department of resources and economic development, shall administer and disburse to the committee established in RSA 4:9-j the moneys in the special account established under RSA 4:9-j. No money other than necessary expenses prior to construction shall be disbursed until the governor and council approve and award the contract for the construction of the Old Man of the Mountain monument.

4:9-j Committee Established; Special Account.

I. A committee is established to select the design for the Old Man of the Mountain monument, to oversee the construction of the monument, to privately raise all the funds which shall be necessary for its construction, and to expend the funds which are raised. The governor is authorized to accept for the committee, in the name of the state, the gifts of money which are donated to construct the monument.

II. The gifts of money which are donated to construct the monument shall be placed in a special nonlapsing account in the state treasury, to be expended for the purposes of the Old Man of the Mountain monument. Any money remaining in the special account after construction of the monument is completed shall be used for the care, maintenance, renovation, or repair of the monument, or for any other purpose deemed appropriate by the committee.

III. The committee shall remain in existence upon the completion of the Old Man of the Mountain monument for the purpose of approving any changes in the monument, such as the addition of names to the monument. Any site changes in the monument shall be made under the supervision of the director of the division of parks and recreation, according to the provisions of RSA4:9-i, II.

4:9-k Committee Membership.

I. The members of the committee established in RSA 4:9-j shall be as follows:

(a) The commissioner of the department of safety, or designee.

(b) The commissioner of the department of cultural affairs, or designee.

(c) The commissioner of the department of administrative services, or designee.

(d) The commissioner of the department of resources and economic development, or designee.

(e) The director of the division of parks and recreation

(f) The members of the privately-established Old Man of the Mountain Legacy Committee, appointed by the governor.

II. The members of the committee shall elect a chairperson from among its members. The first meeting of the committee shall be called by the attorney general. Four members of the committee shall constitute a quorum.

4:9-l Duties of the Committee. The duties of the committee established in RSA 4:9-k shall be as follows:

I. The committee shall select the design for the Old Man of the Mountain monument.

II.(a) The committee shall oversee the construction of the Old Man of the Mountain monument.

(b) The award of the contract for the construction of the Old Man of the Mountain monument shall be subject to the approval of the governor and council.

III. In addition to any state funds appropriated, the committee shall privately raise funds for the planning, design, and construction of the Old Man of the Mountain monument. Notwithstanding subparagraph II(b), the committee shall have the authority to expend the money which is raised without the approval of governor and council.

2 Appropriation. There is hereby appropriated the sum of $2,500,000 for the fiscal year ending June 30, 2010 for the purpose of design and construction of the Old Man of the Mountain monument pursuant to section 1 of this act. The funds shall be deposited into the special account established in RSA 4:9-j. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

3 New Subparagraph; State Treasurer; Application of Receipts. Amend RSA 6:12, I(b) by inserting after subparagraph (276) the following new subparagraph:

(277) Moneys deposited in the Old Man of the Mountain special account established in RSA 4:9-j.

4 Effective Date. This act shall take effect July 1, 2009.

HB 603-FN-A -FISCAL NOTE

AN ACT relative to the construction of an Old Man of the Mountain monument on the shore of Profile Lake and making an appropriation therefor.

FISCAL IMPACT:

      The Department of Resources and Economic Development states this bill will increase state expenditures by $2,500,000 in FY 2010. There will be no fiscal impact on state, county, and local revenues or county and local expenditures.

      This bill appropriates $2,500,000 in FY 2010 from the general fund to the Department of Resources and Economic Development for the purposes of this act.

METHODOLOGY:

    The Department of Resources and Economic Development states this bill authorizes the design and construction of an Old Man of the Mountain monument; establishes a committee for that purpose; and makes an appropriation for the construction of the monument. The Department states the proposed legislation will increase state expenditures by $2,500,000. The Department states the total project cost of the Old Man of the Mountain memorial is approximately $5,000,000. The proposed appropriation provides public funding intended to be matched by private funding. The proposed legislation also allows for the committee to privately raise and expend funds for the planning, design, and construction of the monument and restricts any excess funds raised to be used for the care, maintenance, renovation, or repair of the monument or for any other purpose deemed appropriate by the committee.
