HB 627 FISCAL NOTE

AN ACT relative to the insurance premium tax.

FISCAL IMPACT:

The Insurance Department states this bill will increase state revenue by $5,100,000 in FY 2011, $8,800,000 in FY 2012, and $1,900,000 in FY 2013. There will be no fiscal impact on county and local revenue or state, county and local expenditures.

METHODOLOGY:

This bill freezes the insurance premium tax for a certain period beginning January 1, 2010 and requires the Insurance Commissioner and the Commissioner of the Department of Resources and Economic Development to present a report to the House and Senate Ways and Means Committees relative to jobs and certain insurance revenues. The Insurance Department states this bill postpones further decreases in the insurance premium tax rate scheduled for January 1, 2010 and January 1, 2011 until January 1, 2012 and January 1, 2013. Using the projection models used to project premium taxes and fiscal year revenue, the Department estimates that the proposed legislation will increase state revenues by $5,100,000 in FY 2011, $8,800,000 in FY 2012, and $1,900,000 in FY 2013.

The Department of Revenue Administration acknowledges the proposed legislation will have some effect on the amount of credit available against the business profits tax, however, the Department states it would take a more significant change in the insurance premium tax rate to have much of an impact on reducing the amount of credit available to offset taxpayers’ business profits tax liabilities.

The Department of Resources and Economic Development states the proposed legislation will have no fiscal impact on the Department.
