STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to the responsibility of the state for the infrastructure of state roads that run through certain towns.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 State Responsibility for Infrastructure of State Roads in Towns. Notwithstanding any specifications of an urban compact limiting the department’s maintenance responsibilities to maintaining pavement widths not exceeding 24 feet, the department of transportation shall be responsible for the infrastructure, including road bed and drainage, of state roads running through the following towns: Gorham, Lancaster, Northumberland, Haverhill, Plymouth, Wolfeboro, Jaffrey, Peterborough, Swanzey, Walpole, Pembroke, Farmington, and Newmarket.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 657 FISCAL NOTE

AN ACT relative to the responsibility of the state for the infrastructure of state roads that run through certain towns.

FISCAL IMPACT:

    The Department of Transportation states this bill will increase state Highway Fund expenditures by $586,100 in FY 2010 and $251,100 in FY 2011 and each year thereafter. The New Hampshire Municipal Association states this bill will decrease local expenditures by an indeterminable amount in FY 2010 and each year thereafter. This bill will have no fiscal impact on state, county and local revenues or county expenditures.

METHODOLOGY:

    This bill requires the Department of Transportation to take responsibility for the infrastructure of state roads running through certain towns. The Department of Transportation’s estimate is based on annual maintenance costs of $251,100 associated with the care of the roads detailed within the proposed legislation. In addition to the annual maintenance costs, the Department states there are immediate repairs required in the towns of Haverhill and Farmington that increase highway fund expenditures by an additional $335,000 in FY 2010. The following schedule details the Department’s estimate:

    The Department further notes that their estimate does not include costs associated with future repairs and/or upgrades and that the subject roads are not included in the current ten year plan.

    The New Hampshire Municipal Association states this bill will decrease local expenditures to the extent the proposed legislation makes the state responsible for costs that the listed municipalities would otherwise have to bear.

    This bill does not contain an appropriation.
