HB 696 FISCAL NOTE

AN ACT relative to fees for registration of criminal offenders.

FISCAL IMPACT:

The Department of Safety states this bill will increase state expenditures and local revenue by an indeterminable amount in FY 2010 and each year thereafter. This bill will have no fiscal impact on state and county revenues or county and local expenditures.

METHODOLOGY:

This bill increases the annual registration fees to be paid by criminal offenders from $50 to $70 for tier I and Tier II criminal offenders and to $100 for tier III offenders. The proposed legislation continues to allocate $40 of the fee to the Department of Safety to be used to defray the costs of maintaining the sex offender registry, however increases the allocable amount to municipalities from $10 to $30 for tier I and tier II offenders and allocates $60 to municipalities for each tier III offender. The Department of Safety states local revenue will increase as a result of the increased fee amounts allocable to the municipalities, however, the Department can not estimate the revenue increase as it dies not know how many sex offenders would fall into each tier.

The Department also notes that the proposed legislation requires that funds received be remitted to municipalities on a monthly basis instead of a yearly basis. As such, the Department states that state expenditures will increase by an indeterminable amount as a result of the additional administrative efforts associated with the increased frequency of payments.

Furthermore, the Department states that in the past, increases in the annual registration fee have stimulated an increase in the number of hearings requested by offenders. The Department notes that state expenditures will increase by an indeterminable amount as a result of the subsequent increase in the number of hearings requested and held as a result of the fee increase.
