STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to fees for registration of criminal offenders.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Registration of Criminal Offenders; Registration Fee. Amend RSA 651-B:11, I to read as follows:

I.(a) [An offender] Tier I and tier II offenders shall pay [a] an annual fee of [$50] $70 to the department within 10 days of the registration that occurs within the month of the anniversary of his or her birth. Such payment shall be made in person or shall be mailed to the department. The department shall retain $40 of this amount to be used to defray the costs of maintaining the sex offender registry. Such funds shall be nonlapsing and shall be continually appropriated to the department for such use. The department shall forward the remaining [$10] $30 to the law enforcement agency which registered the offender within the month of the anniversary of the offender's birth to defray any costs associated with implementing the provisions of this chapter. [The department shall forward these fees to the registering law enforcement agencies in a manner determined by the department but no less frequently than once a year.]

(b) Tier III offenders shall pay an annual fee of $100 to the department within 10 days of the registration that occurs within the month of the anniversary of his or her birth. Such payment shall be made in person or shall be mailed to the department. The department shall retain $40 of this amount to be used to defray the costs of maintaining the sex offender registry. Such funds shall be nonlapsing and shall be continually appropriated to the department for such use. The department shall forward the remaining $60 to the law enforcement agency which registered the offender within the month of the anniversary of the offender's birth to defray any costs associated with implementing the provisions of this chapter.

2 Effective Date. This act shall take effect 60 days after its passage.
