STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing a commission to study workforce housing issues.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study workforce housing issues.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) Two members of the house of representatives, one of whom shall be a member of the committee on municipal and county government, appointed by the speaker of the house of representatives.

(b) One member of the senate, appointed by the president of the senate.

(c) The director of the office of energy and planning, or designee.

(d) One member of the Workforce Housing Coalition of the Greater Seacoast, appointed by the coalition.

(e) One member of the Home Builders & Remodelers Association of New Hampshire, appointed by the association.

(f) One member representing the New Hampshire housing finance authority, appointed by the authority.

(g) Five members appointed by the governor, as follows:

(1) One member of a city planning board.

(2) One member of a town planning board.

(3) One member of a village district or county planning board.

(4) One member of a conservation society.

(5) One person knowledgeable on statistical data.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties. The commission shall:

I. Review the need for workforce housing.

II. Review the availability of workforce housing.

III. Review the workability of the definition of workforce housing in existing law.

IV. Review planning board actions relative to workforce housing.

V. Review pending litigation relating to workforce housing.

VI. Consider the need for improving workforce housing laws.

VII. Consider potential legislation that the commission deems necessary relating to workforce housing.

VIII. Propose legislation to provide expedited legal means to exact penalties for failure to comply with affordability provisions adopted in inclusionary zoning ordinances.

4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Five members of the commission shall constitute a quorum.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2011.

6 Effective Date. This act shall take effect upon its passage.
